By using SpaceDuck, you agree to these terms, which establish a binding agreement between you and SpaceDuck Inc.

1. Introduction

Welcome to SpaceDuck, a peer-to-peer package delivery platform that connects travelers with people who need to send packages internationally. SpaceDuck offers two main services:

Delivery Service: Our original package delivery service that connects senders with travelers who can carry packages during their journeys.

Shop&Carry Service: A shopping and delivery service where verified community members can purchase items on behalf of others and deliver them internationally.

These Terms of Service ("Terms") govern your use of our website, services, and applications (collectively, the "Service").

By using our Service, you agree to these Terms and our Privacy Policy. If you disagree with any part of the terms, you may not access the Service.

2. Account Registration

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding the password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to disable any user account at any time if, in our opinion, you have failed to comply with these Terms.

3. Identity Verification and Verified Community

For the safety and security of our community, we require identity verification for all users. This includes:

  • Verification of your government-issued ID
  • Submission of personal information as required
  • Agreement to comply with all platform rules and community guidelines
  • For Shop&Carry service users, additional verification may be required including business registration documents

You agree to provide accurate information during the verification process. Any attempt to falsify information or circumvent our verification processes is a serious violation of these Terms and may result in permanent suspension of your account.

All users must maintain their verified status and comply with platform rules to continue using our services.

4. User Conduct

You agree not to use the Service to:

  • Post or transmit content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity
  • Send or arrange for shipment of illegal, hazardous, or prohibited items
  • Engage in any activity that could damage, disable, overburden, or impair our servers or networks
  • Use automated means, including spiders, robots, crawlers, or data mining tools, to download data from the Service
  • Attempt to gain unauthorized access to any part of the Service

5. Package Listings, Journeys, and Shop&Carry Requests

For Delivery Service:

Senders: You agree that all package listings you create are accurate and complete. You are responsible for ensuring that your packages comply with all applicable laws and regulations in both the origin and destination countries, including customs and import/export laws.

Carriers: You agree to provide accurate information about your journey and available capacity. You are responsible for complying with all applicable laws and regulations, including customs and immigration laws, while carrying packages for other users.

For Shop&Carry Service:

Requesters: You agree that all shopping requests are accurate, complete, and for legitimate purposes. You are responsible for providing clear specifications and ensuring that requested items comply with all applicable laws and regulations.

Shoppers: You agree to purchase only the exact items requested and provide accurate receipts and documentation. You are responsible for complying with all applicable laws and regulations while purchasing and carrying items for other users.

SpaceDuck does not take ownership of packages or purchased items at any point and serves only as a platform connecting users.

6. Prohibited Items

You agree not to send, carry, purchase, or request any of the following prohibited items:

  • Illegal substances or items
  • Hazardous materials, including flammable, explosive, or toxic substances
  • Firearms, weapons, or ammunition
  • Stolen goods or counterfeit items
  • Human remains or body parts
  • Endangered species or products derived from endangered species
  • Live animals
  • Perishable goods without proper approval and handling
  • Items prohibited by customs, import/export regulations, or airline restrictions
  • Items that violate intellectual property rights

This list is not exhaustive, and SpaceDuck reserves the right to refuse any package or shopping request for any reason.

7. Fees, Payment, and Escrow Protection

SpaceDuck charges a service fee for using our platform. Details of our fees are available on our website.

Sender Payment
Senders are required to pay the delivery fee at the time of order creation, or at the latest, immediately after a carrier accepts the delivery request. Failure to complete the payment on time may result in the order being canceled, and the sender may lose priority in selecting a carrier.

Carrier Deposit Hold
Carriers will have a deposit held equivalent to the declared value of the package they accept to deliver. This amount will be fully refunded once the delivery is successfully completed. The deposit ensures accountability and the safety of the package during transport.

Carrier Commission Fee
Carriers agree to pay a 25% service fee to SpaceDuck based on the total amount they receive for each delivery. This fee is automatically deducted from their payment upon successful completion of the delivery.

Escrow Payment Protection

  • For Delivery Service: The buyer confirms successful package
  • For Shop&Carry Service: The buyer confirms receipt of purchased items and satisfaction with the service

You agree not to circumvent our payment system by arranging direct payments with other users outside of the Service.

8. Cancellations and Refunds

Our cancellation and refund policy varies depending on the service and status:

Delivery Service:

  • Before Carrier Acceptance: Full refund of offered price (service fee non-refundable)
  • After Carrier Acceptance but Before Pickup: 80% refund of offered price
  • After Pickup: No refund except in cases of carrier failure to deliver

Shop&Carry Service:

  • Before Shopping Begins: Full refund of offered price (service fee non-refundable)
  • After Shopping Acceptance but Before Purchase: 80% refund of offered price
  • After Items are Purchased: Refund subject to return policy and condition of items

9. Insurance and Liability

All packages and purchased items handled through SpaceDuck include basic insurance coverage up to $500. Additional coverage can be purchased for higher-value items.

SpaceDuck's liability is limited to the declared value of the package/items or $500, whichever is less, unless additional insurance is purchased.

SpaceDuck is not liable for any delays, losses, or damages resulting from customs inspections, flight delays, merchant issues, or other circumstances beyond our control.

10. Disputes and Resolution

In the event of a dispute between users, SpaceDuck will provide a comprehensive dispute resolution process including:

  • Mediation services for delivery issues or disagreements
  • Investigation of claims with supporting documentation
  • Fair resolution based on evidence and platform policies

You agree to cooperate with this process and provide any requested information, including receipts, photos, and communication records.

SpaceDuck's decision in any dispute is final and binding.

11. Platform Responsibility Disclaimer

SpaceDuck acts as a facilitator platform connecting users for delivery and shopping services. Important disclaimers:

  • SpaceDuck does not take possession of packages or purchased items
  • Buyers and travelers/shoppers are primarily responsible for the terms of their individual agreements
  • SpaceDuck provides the platform, payment processing, and dispute resolution but does not guarantee the performance of individual users
  • Users are responsible for complying with all applicable laws and regulations in their respective jurisdictions

12. Termination

We may terminate or suspend your account at any time for any reason, including violations of these Terms.

Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page and updating the "last updated" date.

Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
